Builder, clients face Consumer, Trader and Tenancy Tribunal
GRAFTON-based builder Rick Fischer will be back before the Consumer, Trader and Tenancy Tribunal today, attempting to recover money from a customer.
Mr Fischer's company, Fischer Built Homes P/L trading as GJ Gardner Homes Grafton, has been involved in a number of disputes with clients over the past four years.
A spokeswoman for the tribunal said this morning's hearing of Souter v Fischer involved the builder applying to the tribunal to recover costs of less than $30,000 from the Souters.
But she said there was some tribunal history between Stewart and Christine Souter over the house Mr Fischer's company built for the couple.
Last month the tribunal settled a dispute between Fischer Built Homes and clients Elizabeth and Derek Wood by ordering the company to pay for defective work on their house, completed in 2010.
The tribunal found 10 instances of defective work on the Woods's home that allowed water to get into the house.
It also ordered the company to reimburse the couple for external drainage work done on the advice of the company to remedy the water problems in the house.
Fair Trading NSW has recorded eight complaints against the Grafton franchisee relating to unsatisfactory or allegedly defective work and/or payment disputes since 2008.
As of last month Fair Trading had received no new complaints since February 2012.
In April a meeting called to discuss GJ Gardner Homes attracted a crowd of about 50 people.
Today's hearing will begin at 11.15am in the Grafton Court House.
